LISA R asked: I live in TX and many stores in my area have promotional buy one get one free tobacco items. They have these promotions on cigarettes and cigars. The price of a single pack is priced one way and promotional items given to consumers by the manufactuer are priced higher. Most of these products have printed on them taxes and fees are paid by manufactuer for the free item.
Are these stores allowed to raise the price of an promotional item given to us by the manufactuer to make more profit for themselves?
Example a store has posted that a pack of Newports is $3.99 a pack. They are also selling packs that are bundled because when you buy two, you get one for free. Thses are priced at $11.99 for the 3 pack. If I buy two at $3.99 and am supposed to get one pack for free, how can they charge so much for this promotional item?
If anyone knows any laws in Tx on retailers and price setting please respond.
The 3 packs are bundled by the manufactuer, not the store.
If a single pack is $3.99,
a buy two get one free should be $ 7.98 plus tax on two packs.
But the stores are making a profit on what was packaged for the consumer as a gift. This is my problem.
The manufactuer makes a special box that includes the two packs you must buy at regular price, and this box also includes a free 3rd pack which states on it not for individual resale and taxes on free pack are paid buy the manufactuer.
Can a store charge a consumer for anything for the free 3rd pack given to us by the manufactuer?

We are doing warehousing and order fulfillment of about 25 to 50 orders a month. They want a flat rate of like $4 no matter if we have to pick 5 items or 50 items. Also we will be using UPS or FEDEX and we are required to do monthly reports for them. I need help pricing this job, I just don’t see how we can justify a $4 flat fee.
